Federal Judge Strikes Down Trump’s Executive Order on Transgender Health Care as Unconstitutional

U.S. District Court Judge Lauren King, who had previously issued a temporary restraining order blocking the policy, delivered a more definitive ruling on Sunday, striking down the order for overstepping executive authority and violating constitutional principles.
According to Politico senior legal affairs reporter Kyle Cheney, the judge determined that the executive order “is unconstitutional in multiple ways, including usurping Congress’ power of the purse.” The ruling underscores the ongoing legal battles over transgender rights and healthcare access in the U.S. Trump’s executive order sought to prevent hospitals receiving federal funding from offering gender-affirming care to minors, a move that sparked widespread criticism from civil rights groups and medical organizations.
In her decision, Judge King highlighted a contradiction within the policy, pointing out that it would allow cisgender individuals to receive puberty blockers for medical conditions such as cancer while denying the same treatment to transgender individuals for gender dysphoria or other health needs.

“The judge says Trump’s EO on transgender health care would create a perverse situation in which a cisgender person could get puberty blockers to treat cancer but a transgender person could not get puberty blockers to treat cancer,” Cheney reported.
The order’s opponents argue that restricting access to gender-affirming care violates equal protection under the law and disregards established medical guidelines. Organizations such as the American Academy of Pediatrics and the American Medical Association have consistently affirmed that gender-affirming care is essential for the well-being of transgender youth.
LGBTQ+ advocacy groups have welcomed the ruling as a crucial victory in the fight against government overreach in healthcare decisions. Legal experts also note that King’s decision reinforces the limits of executive power, particularly in areas where Congress holds authority over federal spending.
