Following the break, Justice Merchan firmly addressed Costello, instructing him to remain seated and chastising him for his actions, which reportedly included rolling his eyes and muttering “Jeez!” The judge emphasized the importance of maintaining proper decorum in the courtroom, stating, “If you don’t like my ruling, you don’t give me a side eye or roll your eyes.”

Costello was on the witness stand during Trump’s fifth week in the New York City courtroom, where the former president stands accused of falsifying business records to conceal hush money payments made ahead of the 2016 presidential election. Trump has pleaded not guilty to the charges and denies having an affair with adult film star Stormy Daniels, who District Attorney Alvin Bragg alleges was paid $130,000 through Trump’s former lawyer, Michael Cohen, to keep quiet.

In his testimony, Costello claimed that Cohen had told him Trump “knew nothing” about the hush money payment. This assertion is critical to the defense’s argument that Trump was not involved in any wrongdoing.
