Former President Donald Trump responded to special counsel Jack Smith’s latest legal filing in the federal election conspiracy case with a lengthy outburst on Truth Social, accusing Smith of attempting to interfere in the 2024 presidential election. Trump’s post came after Smith’s filing sought to provide further evidence of Trump’s efforts to overturn the 2020 election results.

“The release of this falsehood-ridden, Unconstitutional, J6 brief immediately following Tim Walz’s disastrous Debate performance, and 33 days before the Most Important Election in the History of our Country, is another obvious attempt by the Harris-Biden regime to undermine and Weaponize American Democracy, and INTERFERE IN THE 2024 PRESIDENTIAL ELECTION,” Trump wrote.

He continued his attack on Smith and the Justice Department, claiming they were part of a broader political plot. “Deranged Jack Smith, the handpicked Prosecutor of the Harris-Biden DOJ, and Washington, D.C.-based Radical Left Democrats, are HELL BENT on continuing to Weaponize the Justice Department in an attempt to cling to power.”

Trump also claimed that his political dominance is what’s driving the case against him, stating, “‘TRUMP’ is dominating the Election cycle, leading in the Polls, and the Radical Democrats throughout the Deep State are totally ‘freaking out.’ This entire case is a Partisan, Unconstitutional, Witch Hunt, that should be dismissed, entirely, just like the Florida case was dismissed!”

Smith’s filing comes in the wake of a Supreme Court ruling that presidents enjoy a presumption of immunity for official acts. However, Smith’s argument hinges on evidence that Trump’s private, non-official actions reveal criminal intent in his efforts to overturn the 2020 election results. The filing attempts to separate Trump’s conduct from his official duties as president, presenting the case as based on his private actions.

Although the filing presents new evidence, the case will not go to trial before the 2024 election. The timing of the filing has added fuel to Trump’s claims of political interference, a narrative he has frequently used throughout his legal battles.

Smith’s filing also comes as he appeals a decision by Trump-appointed Judge Aileen Cannon, who dismissed the Mar-a-Lago classified documents case on the grounds that Smith was not confirmed by the Senate and thus ineligible to bring charges on behalf of the federal government.
